- Assets received through gift, inheritance, or charity and the proceeds from their sale are not included in the calculation of the increase in property.
In this case, "Estate" covers all assets accumulated before and during the marriage, and "contribution" is expanded to include any form of assistance in increasing property, including care of the home and family.
The court's property division decision is based on a comparison of the state of the couple's assets at the time of the marriage and at the time of the divorce, the goal being an equitable distribution based on each party's contribution. Although the court does not divide debts, it does take financial obligations into account when determining property shares in an effort not to disadvantage either party.

- Controllability by the parties. The parties control the process and outcome of mediation, unlike in court proceedings where the judge makes the decision.
